Phil StevensonJuly 3, 2010 at 9:45 am #22743Be certain you are rehoming to a legal state. It is illegal to sell diamondback terrapins in many eastern coastal states, such as New Jersey and Virginia. I realize that this is off topic on this post – but a nice helpful feature for this group would be a posting of the laws regarding capture, ownership, and sales for those states that specifically regulate diamondback terrapins. I don’t have time at the moment but would be willing to help out in the future. There could be significant new regulations if the populations in the gulf are considered to be affected by the oil spill. Any federal listing would put virtually all interstate trade in jeopardy.
Giuseppe IndomenicoJuly 3, 2010 at 10:15 am #22744Phil,I live in New Jersey, and I can say for a fact that it___s not illegal to buy or sell DBT___s in this state. We cannot buy or sell ___within_ our state, but state to state trading is perfectly legal with a dealers permit. Just make sure you know the laws before citing them to people. That___s how misconceptions are started. Thanks, Joe From: diamondbackterrapins@yahoogroups.com [mailto:diamondbackterrapins@yahoogroups.com] On Behalf Of Phil StevensonSent: Saturday, July 03, 2010 9:45 AMTo: diamondbackterrapins@yahoogroups.comSubject: Re: [diamondbackterrapins] need to rehome some terrapins in york, pa. Phil StevensonJuly 3, 2010 at 10:45 am #22745Thanks for your response. My post is correct as it is illegal to trade within the state. Many wildlife agencies have very different ideas about what constitutes interstate vs intrastate commerce. You are placing yourself at the mercy of that person’s idea of commerce on that day.You also clarified the issue of legality – a dealer’s permit is needed. So it is not merely a matter of buying and selling the turtles without first having a permit. So if a person without such a license engages in the activity, it is illegal.I live in Virginia, and Virginia has a very broad prohibition on the sale of native wildlife with exceptions for certain species and certain color morphs. Perhaps you could point to specific portions of the New Jersey state code..the following webpage has a large list of permits required in New Jersey.http://www.state.nj.us/dep/fgw/exotic_apps.htmWhat is also informative to other members of this group is the following link:Below is part of the code of new jersey.7:25-4.2 Permit required(a) Except as hereinafter provided, no person shall possess anynongame species or exotic species of any mammal, bird, reptile oramphibian unless such person has first received both theappropriate permit from the Department as listed in N.J.A.C. 7:25-4.6(a) as well as any other state, municipal, or Federal permits orlicenses which may be required to possess such species.(emphasis added)Here is the link for the full section:http://www.njfishandwildlife.com/pdf/permregs.pdfThe only turtles exempted from this permit are painted turtles and snapping turtles. While there is a list of herps requiring an ownership permit, the law does not specify that those are the only ones. Possibly we will need to refer this discussion to the NJDEP to have them clarify the issue. Thanks for contributing.Phil
